Privacy Policy

Proximate is a macOS utility application developed by XPDynamics LLC. We are committed to protecting your privacy and being transparent about the data we collect. This policy explains what information Proximate collects, how it is used, and your rights regarding that data. Your use of Proximate is also governed by our Terms of Service.

1. Information We Collect

Anonymous Usage Analytics

When analytics are enabled, Proximate collects anonymous usage data to help us understand how the app is used and improve it. This includes:

• Application events (e.g., app launched, preferences opened, feature used)
• macOS version and CPU architecture
• Cursor size setting
• A non-personal internal identifier linked to your license (if applicable)

We do not collect: file contents, browsing history, keystrokes, screenshots, personal documents, or any data from other applications.

License and Purchase Information

When you purchase or activate a license, your email address, name, license key, and a device identifier are stored locally on your computer and communicated with our payment provider to validate your license. For licensed users, your email address and name are shared with our analytics provider (PostHog) to enable service communications as described below.

Trial Email (optional)

When you start a free trial, you may optionally provide an email address. If provided, we store the address locally and with our email processor (Mailjet) so we can send service notifications (trial expiry, billing, account and security matters). If you also tick the "Product updates and occasional offers" box, we additionally add your address to our marketing list. You can unsubscribe from marketing at any time in Settings > Privacy or via the unsubscribe link in any marketing email. Service notifications are transactional and cannot be unsubscribed from; request account deletion to stop all email.

Feedback and Support

If you submit feedback through the app, we collect the message you write and, optionally, your name, email address, and diagnostic information (app version, macOS version, display configuration). Diagnostic data is sanitized to exclude sensitive fields like license keys and email addresses.

2. How We Use Your Information

• Product improvement: Anonymous analytics help us understand which features are used, identify bugs, and prioritize development.
• License management: Purchase data is used solely to verify your license and manage your subscription.
• Customer support: Feedback and diagnostic data help us respond to your questions and resolve issues.
• Communications: If you provide an email address (at license activation or optionally at trial start), it may be used to send (a) transactional messages — critical service notifications, security advisories, license issues, trial and billing notices — which cannot be opted out of; and (b) educational and promotional content (feature tips, product updates, offers) only if you have opted in during onboarding or via Settings > Privacy. You can opt out of (b) at any time.

3. Third-Party Services

Proximate and this website use the third-party services listed below. On this website, services run in three tiers. Anonymous, cookieless usage analytics and session replay (PostHog, see below) run for all visitors — they set no cookies, create no persistent identifier, and are used under our legitimate interest in understanding and improving the site. Advertising measurement (Google and Meta) runs by default but stops if you decline the cookie banner or your browser sends a Global Privacy Control signal. Cookies, cross-session identity, and live chat load only after you click Accept on the cookie banner. You can change your choices at any time (see Your Choices).

Website

• Google Ads — Advertising measurement. When you arrive via a Google ad, we measure whether the visit led to a meaningful action (such as a download or purchase). Some of this measurement happens server-side using your IP address and browser user-agent and may occur before you accept the banner; it is suppressed if you decline or send a Global Privacy Control signal. • Meta Pixel — Advertising measurement and audience building for Meta (Facebook/Instagram) campaigns. We send limited event data (such as page views and download clicks) to Meta to measure ad response; some of this is sent server-side using your IP address and browser user-agent and may occur before you accept the banner, and is suppressed if you decline or send a Global Privacy Control signal. After you Accept, the Meta Pixel may also set cookies and associate activity with your Meta account if you are logged in. Data is processed by Meta Platforms, Inc. in the United States. • PostHog — Product and usage analytics. For all visitors, we capture anonymous, cookieless interaction data (page views, clicks, scroll depth, section views, aggregate heatmaps, and session replay — an anonymous play-back of your visit) with no cookies and no persistent identifier. Email addresses you voluntarily enter into forms may be visible in replays; other text inputs are masked. Only if you click Accept, we additionally enable cookies and cross-session identification. • Tawk.to — Live chat support widget. If you interact with the chat widget, Tawk.to may collect your IP address, browser information, and messages you send. Tawk.to Privacy Policy
• Cloudflare Turnstile — Bot protection for forms (essential; always active). Analyses browser signals to verify you are human. No personal data is stored beyond the verification session. Cloudflare Privacy Policy

App & Payments

• PostHog — Usage analytics and email communications within the desktop app. For licensed users, email address and name are stored to enable service and product communications. If you downloaded the app after clicking an ad, advertising click identifiers (such as from Google or Meta) may be associated with your app install to measure advertising effectiveness. • Sparkle — Automatic update checks. Update checks contact our server to determine if a newer version is available. No personal data is transmitted.
• Mailjet — Transactional email delivery (feedback confirmations, data deletion confirmations, trial and billing notices) and marketing list management (product updates and offers for users who opt in during onboarding or via the in-app toggle).

We do not sell your personal data for money. We do share limited online activity (such as page views and download clicks, together with your IP address and browser user-agent) with Google and Meta to measure and improve our advertising — this is considered "sharing" for cross-context behavioral advertising or a "sale" under some US state laws. You can opt out of this sharing at any time by declining the cookie banner, using the Your Privacy Choices controls, or sending a Global Privacy Control signal (see Your Choices). We do not otherwise sell or rent your personal data, and we never share the contents of your files, messages, or other applications.

4. Your Choices

Website Analytics & Cookie Choices

Anonymous, cookieless usage analytics run for every visitor and set no cookies or persistent identifier. Clicking Accept on the banner additionally enables cookies, cross-session identification, and advertising/conversion tracking. Clicking Decline — or browsing with a Global Privacy Control signal enabled — stops the advertising/conversion tracking and the data we share with Google and Meta, and prevents cookies and identification. Anonymous session replay continues as part of the cookieless analytics. The anonymous, cookieless analytics continue, since they do not identify you or share data for advertising; if you would like to turn those off too, use the toggle below. Your choices are stored in your browser and persist across visits.

App Analytics Opt-Out

You can disable anonymous usage analytics in the macOS app at any time:

• During onboarding, on the Privacy & Analytics step
• In the app: Settings > General > Privacy section

When analytics are disabled, no usage data is sent to PostHog.

Email Communications

Licensed users may receive email communications in three categories:

• Critical service notifications (security advisories, license issues, important service changes) — these cannot be opted out of.
• Educational content (feature tips, how-to guides) — you can opt out at any time.
• Product updates and promotions (upgrade offers, new features) — you can opt out at any time.

You can manage your email preferences:

• In the app: Settings > General > Privacy section
• Via the unsubscribe link included in any promotional or educational email

Experimental Features

You can opt in to preview experimental features. This requires analytics to be enabled so we can measure feature usage and stability.

5. Data Deletion

You can request deletion of your analytics data at any time through any of the following methods:

• In the app: Settings > General > Privacy > "Request Data Deletion"

When you request deletion, we remove your analytics data from PostHog and send a confirmation to the email address on file (if available). Deletion requests are typically processed within 30 days.

Deletion of email subscription data (your Mailjet contact record, including both transactional and marketing list memberships) can be requested via the same channels. Upon receipt we remove the contact from all Proximate lists within 30 days.

6. Your Rights Under GDPR

If you are located in the European Economic Area (EEA), you have the following rights:

• Right of access: Request a copy of your personal data.
• Right to rectification: Request correction of inaccurate data.
• Right to erasure: Request deletion of your data.
• Right to data portability: Request your data in a machine-readable format.
• Right to object: Object to data processing based on legitimate interests.
• Right to withdraw consent: Withdraw your website consent using the Privacy Choices controls above (or send a Global Privacy Control signal), or disable app analytics in Settings.

Lawful basis. We rely on your consent for cookies and advertising tracking, and on our legitimate interest for anonymous, cookieless usage analytics (including session replay) that do not identify you. You can object to legitimate-interest processing at any time by declining the banner, turning off analytics in Privacy Choices, or sending a Global Privacy Control signal.

7. Your US State Privacy Rights

If you are a resident of California, Colorado, or another US state with a comprehensive privacy law, you have the right to:

• Know / access the personal information we collect and how it is used.
• Delete your personal information.
• Correct inaccurate personal information.
• Opt out of the sale or sharing of personal information and of its use for targeted advertising.
• Non-discrimination for exercising these rights.

We do not sell your personal information for money. We do share limited activity data (such as page views and download clicks, together with your IP address and browser user-agent) with Google and Meta for advertising measurement, which is treated as "sharing" / "targeted advertising" (and a "sale" under some laws). To opt out: decline the cookie banner, use the Your Privacy Choices controls in Section 4, or browse with Global Privacy Control enabled — we honor GPC signals as a valid opt-out. 8. Data Retention

Anonymous analytics data is retained for up to 12 months and then automatically deleted. License and purchase data is retained for the duration of your subscription and a reasonable period afterward for record-keeping. Feedback data is retained as long as necessary to resolve your inquiry.

9. Data Security

We take reasonable measures to protect your data. Customer identifiers sent to analytics are internal numeric IDs that do not contain personal information. License keys and sensitive data are stored securely on your device. All network communication uses HTTPS encryption.

10. Children’s Privacy

Proximate is not directed at children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, please contact us and we will promptly delete it.

11. Changes to This Policy

We may update this privacy policy from time to time. We will notify users of significant changes through the app or on our website. The "Last updated" date at the top of this page indicates when the policy was last revised.
