Privacy Policy

Proximate is a macOS utility application developed by XPDynamics LLC. We are committed to protecting your privacy and being transparent about the data we collect. This policy explains what information Proximate collects, how it is used, and your rights regarding that data. Your use of Proximate is also governed by our Terms of Service.

1. Information We Collect

Anonymous Usage Analytics

When analytics are enabled, Proximate collects anonymous usage data to help us understand how the app is used and improve it. This includes:

We do not collect: file contents, browsing history, keystrokes, screenshots, personal documents, or any data from other applications.

License and Purchase Information

When you purchase or activate a license, your email address, name, license key, and a device identifier are stored locally on your computer and communicated with our payment provider to validate your license. For licensed users, your email address and name are shared with our analytics provider (PostHog) to enable service communications as described below.

Trial Email (optional)

When you start a free trial, you may optionally provide an email address. If provided, we store the address locally and with our email processor (Mailjet) so we can send service notifications (trial expiry, billing, account and security matters). If you also tick the "Product updates and occasional offers" box, we additionally add your address to our marketing list. You can unsubscribe from marketing at any time in Settings > Privacy or via the unsubscribe link in any marketing email. Service notifications are transactional and cannot be unsubscribed from; request account deletion to stop all email.

Feedback and Support

If you submit feedback through the app, we collect the message you write and, optionally, your name, email address, and diagnostic information (app version, macOS version, display configuration). Diagnostic data is sanitized to exclude sensitive fields like license keys and email addresses.

Proximate and this website use the third-party services listed below. On this website, services run in three tiers. Anonymous, cookieless usage analytics and session replay (PostHog, see below) run for all visitors — they set no cookies, create no persistent identifier, and are used under our legitimate interest in understanding and improving the site. Advertising measurement (Google and Meta) runs by default but stops if you decline the cookie banner or your browser sends a Global Privacy Control signal. Cookies, cross-session identity, and live chat load only after you click Accept on the cookie banner. You can change your choices at any time (see Your Choices).

We do not sell your personal data for money. We do share limited online activity (such as page views and download clicks, together with your IP address and browser user-agent) with Google and Meta to measure and improve our advertising — this is considered "sharing" for cross-context behavioral advertising or a "sale" under some US state laws. You can opt out of this sharing at any time by declining the cookie banner, using the Your Privacy Choices controls, or sending a Global Privacy Control signal (see Your Choices). We do not otherwise sell or rent your personal data, and we never share the contents of your files, messages, or other applications.

Website Analytics & Cookie Choices

Anonymous, cookieless usage analytics run for every visitor and set no cookies or persistent identifier. Clicking Accept on the banner additionally enables cookies, cross-session identification, and advertising/conversion tracking. Clicking Decline — or browsing with a Global Privacy Control signal enabled — stops the advertising/conversion tracking and the data we share with Google and Meta, and prevents cookies and identification. Anonymous session replay continues as part of the cookieless analytics. The anonymous, cookieless analytics continue, since they do not identify you or share data for advertising; if you would like to turn those off too, use the toggle below. Your choices are stored in your browser and persist across visits.

5. Data Deletion

You can request deletion of your analytics data at any time through any of the following methods:

When you request deletion, we remove your analytics data from PostHog and send a confirmation to the email address on file (if available). Deletion requests are typically processed within 30 days.

Deletion of email subscription data (your Mailjet contact record, including both transactional and marketing list memberships) can be requested via the same channels. Upon receipt we remove the contact from all Proximate lists within 30 days.

If you are located in the European Economic Area (EEA), you have the following rights:

Lawful basis. We rely on your consent for cookies and advertising tracking, and on our legitimate interest for anonymous, cookieless usage analytics (including session replay) that do not identify you. You can object to legitimate-interest processing at any time by declining the banner, turning off analytics in Privacy Choices, or sending a Global Privacy Control signal.

7. Your US State Privacy Rights

If you are a resident of California, Colorado, or another US state with a comprehensive privacy law, you have the right to:

8. Data Retention

Anonymous analytics data is retained for up to 12 months and then automatically deleted. License and purchase data is retained for the duration of your subscription and a reasonable period afterward for record-keeping. Feedback data is retained as long as necessary to resolve your inquiry.

9. Data Security

We take reasonable measures to protect your data. Customer identifiers sent to analytics are internal numeric IDs that do not contain personal information. License keys and sensitive data are stored securely on your device. All network communication uses HTTPS encryption.

10. Children’s Privacy

Proximate is not directed at children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, please contact us and we will promptly delete it.

We may update this privacy policy from time to time. We will notify users of significant changes through the app or on our website. The "Last updated" date at the top of this page indicates when the policy was last revised.
